Who is legally responsible for fly-tipped waste?

Under the Environmental Protection Act 1990 the occupier or landowner is generally responsible for removing waste dumped on private land, even though they did not put it there. Councils will normally clear waste on public land only. Leaving it in place can lead to a notice under Section 59 requiring removal at your own cost, so acting quickly is usually cheaper.

    What clearance costs

A small van load of mixed waste typically costs £180–£350. A tipper load generally runs £400–£800 depending on the material and tip gate fees. Large-scale dumping is priced by tonnage after we see the photographs, and hazardous items such as asbestos sheeting are quoted separately because they need consignment disposal.
