What upper-tier registration means for you
Any business that collects or transports waste produced by others must be registered as an upper-tier carrier with the Environment Agency, and it is a criminal offence under the Environmental Protection Act 1990 for you to pass controlled waste to an unregistered or lower-tier carrier where upper-tier registration is required. As the waste producer you retain a duty of care that does not end when the skip leaves your yard, so it is your responsibility to check the carrier is registered, that the vehicle and driver are named on the collection, and that the waste is taken to a permitted facility.
Transfer notes, consignment notes and your paper trail
Every movement of non-hazardous controlled waste must be accompanied by a waste transfer note describing the waste, its EWC code, quantity and the parties involved, and these must be retained for at least two years. Hazardous waste requires a five-part consignment note under the Hazardous Waste Regulations 2005, retained for three years, with copies lodged with the Environment Agency for certain waste types. We issue correct paperwork at the point of collection so your Duty of Care file is complete without you having to chase it later.
